1. General
Terms and Conditions of Blessings from Africa
1.1 These are the General Terms and Conditions of Blessings from Africa. The general terms and conditions are hereinafter referred to as "GTC".
1.2 Words such as "Customer", "User" or "You" are defined in these "Terms and Conditions" as the person in the form of a natural person and/or on behalf of an organization using our website.
1.3 The “Terms and Conditions” form part of the contract that is formed between Blessings from Africa and you when you have fully completed the order.
1.4 You assure that during the ordering process, on the website and/or via the contact form, you have been given the opportunity to receive further information on these "GTC".

2. Applicability
2.1 The "GTC" apply to the use of our website, to the registration and use of an account, to the use of our application to send a video message, to the orders you have placed and to the contracts and other legal relationships between us. These "GTC" also apply to follow-up and additional orders and new contracts.
2.2 When you register on our website you will be informed that you accept the "Terms and Conditions". When ordering, you will also be informed that you accept the "GTC".

3. Formation of the contract
3.1 We submit our offer to you in the online ordering process on the basis of your specific inquiry or in some other way if we mark this as such.
3.2 You can accept our offer by paying during the ordering process. After receipt of your payment, the order is placed and the contract is concluded under the condition precedent that the upload of the video was successful. Our “Terms and Conditions” apply to all orders.
3.3 We will confirm your order by e-mail and you will receive an invoice if you wish.

4. Conclusion of the contract and delivery
4.1 Immediately after the conclusion of the contract, we begin to implement the same by processing your order.
4.2 We aim to process production of your order by the date you have specified. From the time of placement, the delivery time is at least 2 to 4 working days.
4.3 When configuring the order you can see how it will look like. In the cash register, where you complete the order, you will receive a brief overview of the content of your order.
4.4 Orders are delivered by email within 2 to 4 working days.
Our working days are from Monday to Friday.
4.5 These delivery days are intended for normal use. If the creator has problems with the delivery of the videos, the delivery time can be even longer.

5. Prices and Payment
5.1 The Company reserves the right to change prices at any time. The prices valid on the website https://www.greetingfromafrica.com at the time the contract was concluded apply. The prices valid at the time of the conclusion of the contract apply to the customer.
5.2 Our website contains information about the different payment methods available. As stated above, you place the order by paying in our checkout process. After receipt of your payment, the order and the conclusion of the contract take place under the condition precedent that the upload of the video was successful. After we have received your payment, we will send you a confirmation by email.

6. No right of withdrawal
6.1 As the product has been personalized according to your own specifications, the right of withdrawal does not apply. We set up the process so that there are enough steps in the process where you can fully digitally review your order.

7. Conformity and Complaints
7.1 If you are dissatisfied with the order or our service, we ask that you report this within 14 days of receipt of your order so that we have an opportunity to offer a suitable solution.
7.2 We are not obliged to offer a solution if data has been submitted incorrectly.

8. Video Storage/Management
8.1 The services offered on our website are not intended for the storage of videos. The retention period we use is 3 months for the order placed, after this period the order (history) will be deleted.
8.2 We make responsible and reasonable efforts to ensure that the video is delivered to you within 2 to 4 working days. You are responsible for always saving copies of the video elsewhere. We are not liable for loss of video or other data.
9. Usage Rules
9.1 You warrant that the photos uploaded to our Service through your account will not infringe the rights of any third party. Third party rights include, without limitation, intellectual property rights such as copyright, neighboring rights, design rights, patent rights, trademark rights, trade name rights and trade secret rights. The rights of third parties include personal rights and image rights.
9.2 You also guarantee that the photo uploaded to our Services via your account does not violate criminal law, mandatory legal provisions, public order, good morals or codes of conduct that violate unwritten law.
9.3 You guarantee that in processing your order and performing the contract we will not infringe any third party rights or regulations as mentioned above.
9.4 You warrant that the order you place is for your network to which you have been authorized to access.
9.5 You warrant that the Photos uploaded to our Services are free from viruses, malware or any other form of malicious software or any other content that could affect our Services. You warrant that you will not hack, spam, or use our Services in any way that compromises or disrupts the integrity or operation of our Service.
9.6 We have the right to terminate the Agreement, remove or suspend your photos and to notify the relevant authorities if you breach the “Terms” or if we have serious suspicions that this is the case. We are not liable for any damage resulting from this.

10. Availability of our Services
10.1 We intend to keep our service available to you at all times, but maintenance, security updates, or events or disruptions beyond our control may interrupt our services or your account. We will not be liable for any loss or damage related to such interruptions.
10.2 Our Services are available to you using a computer or device with internet access and an up-to-date internet browser. You have an obligation to take reasonable security measures in relation to your own device and the software you use. We are not responsible for the equipment and software you use when using our services, nor are we liable for any error or loss of data during the transmission of digital files and/or images to our services via computer networks or telecommunications facilities not controlled or served by us.

11. Intellectual Property Rights
11.1 All intellectual property rights, including but not limited to copyrights, neighboring rights, database rights, design rights, trademark rights, trade name rights, trade secrets and patent rights, in and relating to our website, application including know-how related thereto are owned by GreetingFromAfrica 11.2 We are entitled to take technical measures to protect industrial property rights
. You may not remove, avoid or circumvent this protection or allow a third party to do so.
11.3 You may not incorporate or combine any part of our Website, the Blessings from Africa Application and Services, in whole or in part, into or with any software not provided by us.

12. Data protection "GDPR"
12.1 We are committed to protecting your personal information. We process personal data of our customers in accordance with the EU General Data Protection Regulation (GDPR). Read our privacy and cookie statement for more information about our processing of personal data.
12.2 In our privacy policy, we explain that you make the assignment on the basis of your consent. By means of the "Terms and Conditions" you expressly give your consent to this.
12.3 You are solely responsible for the video you provide to us and the details of your network to which we must send it.
12.4 You have the right to withdraw your consent at any time. However, the revocation of the consent does not affect the legality of the processing carried out up to the point of revocation.
12.5 Young people under the age of 16 need the permission of their parents or legal guardians to place an order.

13. General information on how the Internet works
13.1 Despite the control you have over your account and the way we have set up the Services, internet availability can never be fully controlled. For example, your video message may be saved by people you share it with, for example by taking screenshots or otherwise, even after you delete the video message. We trust that you understand this and expressly disclaim any liability for it.
